The rapid advancement of artificial intelligence (AI) technology has brought significant social and legal changes, raising new concerns regarding the right of publicity and its applicability. In particular, the development of generative AI has led to increasing cases of unauthorized use and commercial exploitation of individuals' images, voices, and identities, highlighting the need for a legal framework to address such issues.
This study examines the historical development and current legal status of the right of publicity while exploring emerging dilemmas in the AI era and possible legal responses. The necessity of establishing clear and consistent legal standards to protect individual dignity and prevent the commercial misuse of one’s likeness and identity is emphasized. Furthermore, a comparative analysis with the United States provides insights into potential legislative improvements required in South Korea to meet evolving social demands driven by technological advancements.
